Anwar appeals against transfer of sodomy trial
KUALA LUMPUR, March 6 – Opposition leader Datuk Seri Anwar Ibrahim today filed appeals with the High Court and the Court of Appeal against the decision to transfer his sodomy trial from the Sessions Court to the High Court.
The Kuala Lumpur High Court had yesterday held that Sessions Court judge SM Komathy Suppiah had erred when she decided that the certificate of transfer signed by Attorney-General Tan Sri Abdul Gani Patail was not valid.
In her ruling, Komathy had said that the case raised “a unique situation where it is evident that any involvement by the A-G in this case would seriously undermine public confidence in the administration of criminal justice.”
She also said that there was an understanding that the A-G would not be involved in the case. This assurance was given by Prime Minister Datuk Seri Abdullah Ahmad Badawi.
Gani is still under investigation following a police report lodged by Anwar about the alleged tampering of evidence pertaining to the “black eye” incident in 1998.
